Please read these Terms of Service carefully before using the Rebirth of Fitness mobile application or website (rebirthapp.co.za). By downloading, installing, or using the app, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using Rebirth of Fitness ("the App"), you confirm that you are at least 16 years of age, have read and understood these Terms of Service, and agree to be bound by them. If you do not agree, you must not use the App.

2. Description of Service

Rebirth of Fitness provides a fitness training platform including workout programs, nutrition guidance, run tracking, hybrid and HYROX training, Women's Hub cycle-synced programming, AI coaching, and race simulation. The App is available as a free tier and via paid subscription.

3. Subscriptions & Billing

Rebirth of Fitness offers optional paid subscription plans (Monthly, Six-Month, and Annual) that unlock premium features. Subscriptions are processed through the Apple App Store or Google Play Store via RevenueCat. By subscribing you agree to the following:

• Subscription fees are charged to your App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription through your Apple ID or Google Play account settings
• Price changes will be communicated in advance; continued use after a price change constitutes acceptance

4. Refund Policy

This policy applies regardless of the reason for cancellation, including but not limited to change of mind, failure to cancel before renewal, or dissatisfaction with the content. Cancelling your subscription stops future billing but does not entitle you to a refund for any amount already charged.

If you believe a charge was made in error or without authorisation, you may contact your App Store or payment provider directly. Rebirth of Fitness is not responsible for refund decisions made by Apple or Google.

5. Free Trial

Where a free trial is offered, it converts automatically to a paid subscription at the end of the trial period unless cancelled beforehand. You will not be charged during the trial period.

6. User Accounts & Responsibility

You are responsible for:

• Maintaining the confidentiality of your account and device
• All activity that occurs under your account
• Providing accurate information during onboarding and profile setup
• Ensuring that any health and fitness data you enter is accurate and up to date
• Using the App in compliance with applicable laws and these Terms

7. Health Disclaimer

You acknowledge that physical exercise carries inherent risks. Rebirth of Fitness accepts no liability for injury, illness, or adverse health outcomes arising from use of the App or following its programming. AI-generated training recommendations are automated suggestions only and do not constitute medical or professional advice.

8. Intellectual Property & Copyright

All content within the App — including workout programs, training plans, written content, graphics, branding, visual identity, and software — is the exclusive property of Rebirth of Fitness and is protected by copyright and intellectual property law under the Copyright Act, 1978 (South Africa) and applicable international conventions.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or sell any part of the App or its content without prior written consent from Rebirth of Fitness.

9. Algorithm & Platform Protection

You expressly agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code or logic of any algorithm or feature within the App
• Systematically extract, scrape, or harvest data from the App to replicate, reproduce, or train competing systems
• Use the App — or data generated from using the App — to develop, train, or improve a competing fitness platform, algorithm, or AI coaching system
• Copy, reconstruct, or distribute any proprietary methodology, scoring system, or program structure

Violation of this section may result in immediate account termination and legal action to recover damages, including injunctive relief.

10. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable regulation
• Share your account credentials or allow others to access your subscription
• Create multiple accounts to circumvent subscription limits or access restrictions
• Impersonate another user, person, or entity within the App
• Use automated bots, scripts, or tools to interact with the platform
• Scrape, harvest, or collect data from the App without written permission
• Upload any harmful, offensive, defamatory, or infringing content
• Interfere with or disrupt the integrity or performance of the App or its servers

11. Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms of Service. Upon termination, your right to use the App ceases immediately. No refund will be issued for the remaining subscription period in the event of termination due to a breach of these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, Rebirth of Fitness and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

13. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date above. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
